1. Acceptance of Terms

By accessing and using Habicult, you agree to be bound by these Terms of Use.

2. Description of Service

Habicult is a habit tracking and coaching platform that enables coaches to create habit trackers and manage groups of participants ("buddies") working towards common goals. The Service includes features for check-ins, progress tracking, and group accountability.

3. Individual Ownership

Habicult is currently owned and operated by an individual, not a company. This status may change in the future, and these terms will be updated accordingly if that occurs.

4. User Accounts

You must create an account to use our service. You are responsible for maintaining the confidentiality of your account information. You must be at least 13 years old to use this service.

5. Acceptable Use

You agree not to use the service for any unlawful purpose or in any way that could damage, disable, or impair the service.

6. Token System

Habicult uses a token-based system for creating and managing habit trackers. Tokens are purchased by coaches and consumed when creating tracker sheets. Each tracker creation requires a certain number of tokens based on the tracker configuration. Tokens do not expire but are non-refundable once purchased. Unused tokens remain in your account and can be used for future tracker creation.

7. Public Tracker URLs and Data Sharing

Habit trackers created on Habicult have unique public URLs that allow loginless check-ins. Anyone with access to a tracker URL can view the tracker contents, including participant names, check-in data, and progress information. As a coach, you are responsible for sharing tracker URLs wisely and consciously. Only share URLs with intended participants and trusted individuals. Habicult is not responsible for unauthorized access resulting from URL sharing.

8. Intellectual Property and User Rights

a) The habit tracking data and content you create using our tool belongs entirely to you. You have full ownership and all rights to use this data for any purpose.

b) You are free to export, modify, or use your habit tracking data in any way you see fit, without any restrictions from us.

c) We do not claim any ownership rights to the data you create using our service.

d) However, we retain all rights to our software, algorithms, and the underlying technology of Habicult.

e) By using our service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving our service.

9. Coach-Participant Relationships

Habicult provides a platform for habit tracking and accountability but does not create, supervise, or control the relationship between coaches and participants. Coaches are solely responsible for their interactions with participants. Habicult is not liable for any disputes, issues, or outcomes arising from coach-participant relationships. Coaches should maintain professional boundaries and ethical practices when working with participants.

10. Fair Use Policy

Users are expected to use the service reasonably and not abuse the system through automation or excessive API calls that could impact server performance and service quality for other users.

11. Service Availability

The service is provided "AS IS" and "AS AVAILABLE". We do not guarantee that the service will be uninterrupted, secure, or error-free. Service may be temporarily unavailable due to maintenance, updates, or technical issues beyond our control.

12. Limitation of Liability

We are not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

13. Account Termination and Data Deletion

We reserve the right to terminate or suspend your account for any reason, including violation of these terms. If you wish to delete your account or request deletion of your data, please contact us at algocattech@gmail.com. We will process your request and delete your personal information in accordance with our Privacy Policy and applicable laws.

14. Refund Policy

We do not offer refunds for the token purchase at this point.

15. Changes to Terms

We may modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
